Terms & Legal Notice

Last updated October 30, 2026. These terms apply to killmoe.co, the Kill Moe store portal, our messages and texts, and any order placed with us. By using the site you agree to them. If you don't agree, don't use the site.

1. Who we are

Kill Moe is a brand of KM Distribution LLC ("Kill Moe," "we," "us"). Questions about these terms: use our contact form.

2. Adults 21+ only

This site is only for adults 21 or older. Kill Moe products contain tobacco and nicotine and are not for sale to anyone under 21. By using the site, sending us a message, signing up for updates or entering a promotion, you confirm you're 21 or older. We may ask for proof of age and may refuse to answer, ship or continue any communication with anyone who can't confirm it. If we learn someone under 21 has given us information, we delete it.

3. We sell to businesses only

Kill Moe does not sell or ship tobacco products to consumers. Nothing on this site is an offer to sell to an individual. We sell only to licensed tobacco retailers and wholesalers through our store portal, our sales team, or authorized distributors. Consumers buy Kill Moe from independent retail stores, which make their own sales and are responsible for them (see section 5). The store finder is for information only; we don't control a store's stock, prices or practices.

4. Terms for retailers and wholesalers

  • Accounts. To buy, a business must apply and hold a current tobacco retail or wholesale license (and any other permits) in its state and locality. We may approve, refuse, suspend or close any account at our discretion, and may ask for a copy of any license at any time.
  • Accuracy. You confirm that what you tell us about your business, license, address and authority to order is true, and you'll tell us promptly if it changes, lapses or is suspended.
  • Orders. Orders are offers to buy and aren't binding until we accept them. We may limit quantities, cancel orders (for example, for a pricing error, a license problem, or a legal restriction where you're located) and change prices and products without notice.
  • Payment. Payment terms are the ones on your invoice or account. Late balances may lead to holds on future orders.
  • Delivery, title and risk. Title and risk of loss pass to you when the product is delivered to your business or handed to your carrier. Check deliveries when they arrive and report shortages or damage within 48 hours.
  • Returns. Except for products that were damaged or defective when delivered, sales are final unless we agree otherwise in writing.
  • Confidentiality. Wholesale prices, terms and any messages we send your business are confidential and only for your business. Don't publish or share them.
  • No agency. Retailers and wholesalers are independent businesses, not our agents, employees, partners or franchisees.

5. Retailer compliance

Every business that resells Kill Moe is solely responsible for following all federal, state and local laws on the sale, display and advertising of tobacco products, including:

  • checking photo ID and selling only to adults 21 or older;
  • keeping every required license and permit current, and following any state or local limits (for example, the District of Columbia's ban on flavored tobacco and any limits near schools);
  • selling products only as packaged, with all required warnings, and not re-packaging, re-labeling, splitting packs or changing them;
  • using only Kill Moe display and advertising materials we provide or approve, in the way local law allows, and making no health or safety claims about the product;
  • not giving away free tobacco products or samples to consumers;
  • collecting and paying all taxes that apply to its sales.

We may stop selling to any business that breaks these rules.

6. Product information and warnings

Tobacco use carries serious health risks. Kill Moe makes no claim that its products are safe, safer, less harmful, natural or additive-free, or that they help anyone stop using tobacco, and nothing on this site, in our messages or from our team should be read that way. Product photos, descriptions and availability are for general information and may change. Keep tobacco products out of reach of children and pets.

7. Messages and texts

  • We answer general questions only from adults 21+. We reply only after age is confirmed, and we may ask you to confirm it again.
  • Business messages about orders, pricing and accounts are only for store owners, retailers and wholesalers.
  • Messages from us are meant only for the person or business they're addressed to. If you get one by mistake, delete it and let us know. Don't forward our messages to anyone under 21.
  • Store text messages are sent only to businesses that opt in and follow the program terms shown when signing up. Reply STOP to opt out or HELP for help. Message and data rates may apply.
  • Messages sent through this site aren't secure for sensitive information. Don't send us card numbers, IDs or passwords.
  • We don't give medical or legal advice, and nothing we send is an offer to sell to a consumer.

8. Promotions and the Drop

Sweepstakes and promotions, including the Kill Moe Monthly Drop, are governed by their own official rules (see Drop rules). If those rules conflict with these terms, the official rules control for that promotion. Promotions are open only to eligible adults 21+ and are void where prohibited.

9. Our name and content

The Kill Moe name, logo, skull mark, packaging, photos, text and design are owned by or licensed to KM Distribution LLC. You may not copy, sell or use them (including to make look-alike products or sites) without our written permission. Authorized retailers may use the materials we provide only to sell genuine Kill Moe products.

10. No warranties

The site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the site will be error-free, uninterrupted or free of harmful code.

11. Limits on liability

To the fullest extent the law allows, Kill Moe and KM Distribution LLC, and their owners, employees and agents, are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from the site, our communications, or any product sold by a third-party retailer. Our total liability for any claim relating to an order is limited to the amount the buying business paid us for the product at issue, and for any other claim to one hundred dollars ($100).

Some places don't allow some of these limits, so they may not all apply to you.

12. Your responsibility to us

You agree to defend, indemnify and hold harmless Kill Moe, KM Distribution LLC and their owners, employees and agents from claims, losses and costs (including reasonable attorney's fees) that come from your misuse of the site, your breach of these terms, false information you gave us, or, for businesses, your resale, display or advertising of our products, including any sale to someone under 21 or any violation of law by your business.

13. Governing law and disputes

These terms are governed by the laws of the District of Columbia, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try in good faith to resolve it for at least 30 days. If a court finds any part of these terms unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver of it.

14. Changes and contact
